GENERAL TERMS AND CONDITIONS OF SALE FOR THE ONLINE SHOP

Article 1 – Purpose

The purpose of these terms and conditions is to define the general terms and conditions of sale for products offered by:

hereinafter referred to as ‘NJ’,

via its e-commerce site accessible at the Internet address https:nj-creation.com/

hereinafter referred to as ‘the Shop’,

Article 2 – Applicability, enforceability

These general terms and conditions of sale apply, to the exclusion of all other general or specific terms and conditions or any other document, including advertising material, to all purchases made via the Shop.

They are enforceable, to the exclusion of all other general or specific terms and conditions or any other document, including advertising material, against any person, whether a trader or not, hereinafter referred to as ‘the Customer’, purchasing via the Shop.

NJ is free to modify these general terms and conditions of sale at any time.

The applicable and enforceable general terms and conditions of sale are those in force on the date of the order.

Article 3 – Products

• Presentation

Each product reference offered via the Shop is accompanied by an online description of its essential characteristics.

NJ is free to withdraw one or more product references offered via the Shop at any time.

The photographs and colour charts that may be used to support the description shall not in any way and on any basis whatsoever bind NJ.

• Duration of the offer

The said products are offered for sale as long as they remain, due to NJ, accessible via the Shop, within the limits of available stocks.

• Prices

The prices of products offered through the Shop are indicated in euros, including all French taxes, and in dollars, excluding delivery costs, and remain valid as long as they remain accessible through the Shop due to NJ.

However, in the event of a change in the VAT rate applicable in France, the impact may be immediate, including for orders currently being processed. The price in dollars may be adjusted in line with market fluctuations.

NJ is free to change prices at any time in the absence of a final order.

The customer will be informed of the delivery costs before finally confirming the order.

Article 4 – Order

• Process

Products offered for sale via the Shop are ordered online according to the following process:

- selection of the product(s);

- verification of the selected product(s);

- if necessary, modification of the selected product(s) and verification of the modified order;

- consult the general terms and conditions of sale, with the option to print and/or download them;

- unreserved acceptance of the general terms and conditions of sale;

- entry by the customer of the personal data necessary for processing the order (surname, first name, delivery address, billing address, email address, etc.);

- choosing the payment method (credit card, cheque, bank transfer);

- checking the order details, in particular the total price (delivery costs, any discounts, amount excluding VAT, VAT rate applicable on the day of the order, VAT amount, amount including VAT);

- if necessary, modification of the information entered and verification of the modified order;

- final confirmation of the order;

- if necessary, payment by credit card or cheque.

Each of these order stages is represented by a specific screen page.

The Customer can only access one of these stages after having validated the previous stage.

Until the order is definitively confirmed, the Customer may freely return to the previous steps, in particular to make changes.

• Formation of the sale

The definitive confirmation of the order forms the sales contract between NJ and the Customer relating to the goods ordered.

• Order acknowledgement

Once the order has been definitively confirmed, NJ will immediately acknowledge receipt on screen, with the option for the Customer to print it, and as soon as possible at the email address provided by the Customer.

NJ cannot be held liable if it is unable to send confirmation by email due to reasons attributable to the Customer, in particular if the email address provided by the Customer is non-existent, incorrect, invalid or full.

• Retention

The general terms and conditions of sale in force at the time of the order and the order confirmation shall be retained by NJ for a period of ten years from the delivery of the order.

The Customer may obtain a digital copy upon request.

Article 5 – Payment

The Customer may choose from the following payment methods:

- payment by credit card via the secure online payment system.

- payment by cheque made payable to NJ Diffusion Sarl, sent to NJ Diffusion Sarl, 66 rue de la Pompe, 75116 Paris, France, payable at a French bank without exchange fees or commission.

Article 6 – Shipping, delivery

The products ordered and paid for will be shipped to the Customer at the delivery address provided by them when placing the order, as soon as possible and no later than thirty days after full payment for the order, which is:

- immediate in the case of payment by credit card (in principle only, as payments by foreign cards may give rise to a special authentication or verification procedure that slows down the processing of the order)

- deferred upon receipt in the case of payment by cheque. The delivery costs indicated at the time of ordering are payable by the Customer.

- deferred upon receipt in the case of payment by bank transfer. 

In the event of delivery outside French territory, the Customer shall also bear any taxes and customs duties that may apply. NJ is under no obligation to verify and inform the Customer of any applicable taxes and customs duties in such cases. This verification is the responsibility of the Customer.

If the product ordered is unavailable, the Customer will be informed as soon as possible and will be refunded the sums paid for the purchase of this product within thirty days of payment at the latest. The refund will be made by bank cheque made out to the Customer and, unless otherwise specified by the Customer, sent to the billing address indicated on the order.

Any failure or delay in delivery attributable to the specific service provider is its responsibility.

Article 7 – Right of withdrawal

The Customer has a right of withdrawal of fifteen working days from receipt of the ordered product, provided that it has not been worn (except for trying it on with the protective cape), altered, cut or readjusted. If the order was delivered to a business and the product is not suitable, it is the customer's responsibility to return the product in order to obtain a refund (see conditions below).

The exercise of this right is not subject to any justification or penalty.

However, the Customer is responsible for the cost of returning the product.

In this case, the product must be returned to the following address: NJ DIFFUSION 66 rue de la Pompe 75116 PARIS in perfect condition in its original undamaged packaging and accompanied by all its accessories, instructions, warranty and a copy of the purchase invoice. For hygiene reasons, wigs and hairpieces must not have been worn or styled and must have the label attached to the cap.

If the Customer exercises this right regularly, NJ will refund the Customer the sums paid by them for the purchase of the returned product(s) within a maximum period of thirty days.

Article 8 – Personal Data

Pursuant to Law No. 2004-801 of 6 August 2004 on the protection of personal data, amending Law No. 78-17 of 6 January 1978 on information technology, files and freedoms:

The Customer is informed that the personal data concerning them, entered by them when placing an order, are subject to computer processing intended for the processing of their order.

This data may also be used for commercial follow-up purposes, particularly so that the customer may be informed, notably by email, of the Boutique’s commercial offers.

However, the customer may object to such follow-up:

  • either at the time of ordering by ticking the box offering this option;

  • or, failing that, by expressly notifying NJ at the email address provided for this purpose on any follow-up correspondence, particularly emails sent to them.

NJ is the data controller for this processing.

This processing has been declared to the French National Commission for Information Technology and Civil Liberties (CNIL) under the number: 1097848.

However, this does not concern the processing of data provided to the banking service provider responsible for securely handling payment for orders by bank card on behalf of NJ. Only this service provider is responsible for processing this data.

The Customer is also informed that failing to enter the mandatory personal data requested during the ordering process described above prevents the order from being successfully completed.

Article 9 – Complaints – Customer Service

Article 10 – Applicable Law

This contract is governed by French law. The language of this contract is French. If it is translated into a foreign language, only the French version shall prevail.

Article 11 – Disputes

In the event of a dispute, only the French courts shall have jurisdiction. In the event of a dispute with a merchant, only the commercial courts of NJ’s registered office shall have jurisdiction.

Article 12 – Retention of Title Clause

12.1 – The goods we deliver are sold with a retention of title clause, expressly making the transfer of ownership conditional upon full payment of the principal price and any additional sums.

It is understood that the mere delivery of an instrument creating an obligation to pay—such as a bill of exchange or any other document—does not constitute payment. NJ DIFFUSION’s original claim against the purchaser remains valid, along with the guarantees attached to it, including the retention of title, until the payment instrument or commercial paper has actually been paid.

In the absence of full payment by the due date, NJ DIFFUSION may request the return of the goods sold.

12.2 – The above provisions do not prevent the purchaser, upon delivery or transfer of the goods to the carrier, from assuming all risks related to loss, deterioration, destruction or theft of the goods subject to retention of title, as well as liability for any resulting damages.

The transfer of ownership is therefore separate from the transfer of risks to the purchaser.

This clause is governed by Articles 2367 to 2372 of the French Civil Code and Article L 624-16 paragraph 2 of the French Commercial Code.
